The following information provides a simple overview of what happens to your personal data when you visit this website or use other services associated with us. Personal data refers to all data with which you can be personally identified. Detailed information on the processing of your personal data can be found in the subsequent sections of this privacy policy.
Data processing on this website is carried out by us, the website operator. You can find our contact details in the "Information on the Controller" section of this privacy policy.
We collect your data when you provide it to us (e.g., as part of a contact request). Note that technical data (e.g., your internet browser, operating system, or the date and time of a page request) will be processed automatically when you visit the website. In addition, we store certain page settings selected by you (e.g., light or dark appearance and language selection) locally on your device.
Part of the data is collected to ensure the error-free provision of the website and to retain your page settings when you visit again. We use other data to process your inquiries. We do not analyze your user behavior on this website.
You have the right at any time to obtain, free of charge, information about the origin, recipients, and purpose of your stored personal data. You also have the right to request the rectification or deletion of this data. If you have given consent to the processing of your data, you may withdraw that consent at any time with effect for the future. Furthermore, under certain circumstances, you have the right to request the restriction of the processing of your personal data. You also have the right to lodge a complaint with the competent supervisory authority. Likewise, under the applicable legal requirements, you have the right to data portability—that is, the right to receive the personal data you have provided in a structured, commonly used, and machine-readable format or to request that it be transmitted to another controller. Furthermore, you have the right to object; more information on this can be found in Section 3. You may contact us at any time regarding this or any other questions concerning data protection.
Our offer is not specifically aimed at children under the age of 16. For the processing of personal data based on consent within the meaning of Art. 6 Para. 1 lit. a GDPR and for which Art. 8 GDPR applies, the consent or agreement of a legal guardian is required for children under 16.
We use the following hosting provider:
Netlify, Inc., 101 2nd Street, San Francisco, CA 94105, USA
This website is hosted externally. The personal data collected on this website is stored on the host's servers. This may include, in particular, IP addresses, metadata and communication data, contact details, names, website access data, and other data generated through the use of a website. External hosting is carried out in the interest of ensuring the secure, fast, and efficient provision of our online offering by a professional provider (Art. 6 Para. 1 lit. f GDPR).
Where personal data is transferred to the USA or other third countries, the transfer takes place, according to Netlify's information, on the basis of the applicable transfer safeguards. In particular, this includes the safeguards provided by the EU-U.S. Data Privacy Framework, for which Netlify is certified, or the Standard Contractual Clauses of the European Commission.
We have concluded a Data Processing Agreement (DPA) for the use of the aforementioned service in accordance with Art. 28 GDPR. This is a contract that ensures that the host processes the personal data of our website visitors only according to our instructions and in compliance with the GDPR.
Further information on this can be found at https://www.netlify.com/pdf/netlify-dpa.pdf.
We take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with applicable data protection laws and this privacy policy. When you use this website, various types of personal data are collected. Personal data refers to data with which you can be personally identified. This privacy policy explains what data we collect and what we use it for. It also explains how and for what purpose this happens. We point out that data transmission over the internet (e.g., during communication via email) may be subject to security vulnerabilities. Complete protection of data against access by third parties is not possible.
The provision of personal data is generally neither legally nor contractually required for the mere visit of our website. Where provision is required for specific contact or contractual processes, this is set out in the respective subsequent sections.
The controller responsible for data processing on this website is:
Jacob Michalski
c/o IP-Management #11877
Ludwig-Erhard-Str. 18
20459 Hamburg
Germany
Email: contact@interclockgames.com
Telephone: +4915253467686
The controller is the natural or legal person who decides, alone or jointly with others, on the purposes and means of processing personal data (e.g., names, email addresses, etc.).
Unless a specific storage period is stated in this privacy policy, your personal data will remain with us until the purpose for processing no longer applies. If you make a valid request for the deletion of your data or withdraw your consent to data processing, your data will be deleted unless we have other legally permissible grounds for retaining it (e.g., tax or commercial retention obligations); in the latter case, the data will be deleted once those grounds no longer apply.
If you have consented to data processing, we process your personal data on the basis of Art. 6 Para. 1 lit. a GDPR. You may withdraw consent at any time with effect for the future. If processing is necessary for the performance of a contract or to carry out pre-contractual measures, it is carried out on the basis of Art. 6 Para. 1 lit. b GDPR. Furthermore, we process your data where this is necessary for compliance with a legal obligation on the basis of Art. 6 Para. 1 lit. c GDPR.
Data processing may also take place on the basis of our legitimate interest pursuant to Art. 6 Para. 1 lit. f GDPR. Information on the specific legal bases applicable in each individual case is provided in the following sections of this privacy policy.
As part of our business activities, we work with various external parties (e.g., hosting providers). In some cases, this requires the disclosure of personal data to these parties. We only disclose personal data to external parties where this is necessary for the performance of a contract, where we are legally obliged to do so (e.g., disclosure to tax authorities), where we have a legitimate interest in the disclosure pursuant to Art. 6 Para. 1 lit. f GDPR, or where another legal basis permits the disclosure. Where we jointly determine the purposes and means of processing with other controllers and joint controllership therefore exists under Art. 26 GDPR, we conclude or enter into an appropriate Art. 26 GDPR agreement where required and available. Joint controllership under Art. 26 GDPR may exist regardless of whether a corresponding agreement has actually been concluded between the joint controllers.
If the processing of personal data is based on your consent, you can withdraw it at any time with effect for the future. The lawfulness of the data processing carried out until the withdrawal remains unaffected by the withdrawal.
Right to Object to the Processing of Personal Data in Special Cases as well as to Direct Marketing (Art. 21 GDPR)
IF DATA PROCESSING TAKES PLACE ON THE BASIS OF ART. 6 PARA. 1 LIT. E OR F GDPR, YOU HAVE THE RIGHT AT ANY TIME, FOR REASONS ARISING FROM YOUR SPECIAL SITUATION, TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH A PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR PERSONAL DATA, UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING THAT OVERRIDE YOUR INTERESTS, RIGHTS, AND FREEDOMS OR IF THE PROCESSING SERVES THE ESTABLISHMENT, EXERCISE, OR DEFENSE OF LEGAL CLAIMS (OBJECTION UNDER ART. 21 PARA. 1 GDPR). IF YOUR PERSONAL DATA IS PROCESSED TO CONDUCT DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR SUCH MARKETING PURPOSES; THIS ALSO APPLIES TO PROFILING AS FAR AS IT IS RELATED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR DIRECT MARKETING PURPOSES (OBJECTION UNDER ART. 21 PARA. 2 GDPR).
In the event of violations of the GDPR, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, your place of work, or the place of the alleged infringement. This right to lodge a complaint exists without prejudice to any other administrative or judicial remedies.
In accordance with Art. 20 GDPR, you have the right to receive the personal data that you have provided to us and that we process by automated means on the basis of your consent or in the performance of a contract in a commonly used, machine-readable format, or to have this data transmitted to yourself or to a third party. If you request the direct transmission of the data to another controller, this will only take place where technically feasible.
Within the framework of applicable legal provisions, you have the right at any time to receive, free of charge, information about your stored personal data, its origin and recipients, and the purpose of the data processing, and, where applicable, the right to rectification or deletion of this data. You can contact us at any time regarding this or any other questions concerning personal data.
You have the right to request the restriction of the processing of your personal data.
You can contact us at any time regarding this. The right to restriction of processing exists in the following cases:
If you dispute the accuracy of your personal data stored by us, we generally need time to verify this. For the duration of this verification, you have the right to request the restriction of the processing of your personal data. If the processing of your personal data is unlawful, you may request restriction of processing instead of deletion. If we no longer need your personal data but you require it for the establishment, exercise, or defense of legal claims, you also have the right to request restriction of processing instead of deletion. If you have objected to processing under Art. 21 Para. 1 GDPR, a balancing of your interests against ours must be carried out. As long as it has not yet been established whose interests prevail, you have the right to request the restriction of the processing of your personal data.
Where the processing of your personal data has been restricted, this data may, apart from being stored, only be processed with your consent or for the establishment, exercise, or defense of legal claims, for the protection of the rights of another natural or legal person, or for reasons of important public interest of the European Union or a Member State.
This site uses SSL or TLS encryption for security reasons. You can recognize an encrypted connection by the fact that the website is accessed via HTTPS and the browser indicates this accordingly. SSL or TLS encryption protects the transmission of data between your browser and our website from unauthorized interception by third parties.
When accessing our website, Netlify, as the hosting provider, automatically processes technical information and stores it in server log files.
These include:
The collection of this data is based on Art. 6 Para. 1 lit. f GDPR. We have a legitimate interest in the technically error-free presentation and accessibility of our website. For this purpose, server log files must be collected.
Netlify stores the server log files for a limited period. Under our current plan, we only have access to limited observability analytics (an overview of access and error numbers), which are available to us for 24 hours. We do not make any further use of the log data. However, this 24-hour period during which the observability analytics are available is not the same as the deletion period for the actual technical server logs at Netlify. We have no influence over Netlify's specific technical deletion processes or any further internal retention of the data.
If you contact us via email, telephone, post, or through the direct message function of our social media profiles, we process the personal data you provide for the purpose of handling your inquiry. The processing of this data is based on Art. 6 Para. 1 lit. b GDPR, provided that your request is related to pre-contractual or contractual measures.
In all other cases, the processing is based on our legitimate interest in effectively handling the inquiries addressed to us (Art. 6 Para. 1 lit. f GDPR) or on your consent (Art. 6 Para. 1 lit. a GDPR), where consent has been requested. You may withdraw consent at any time with effect for the future.
If you contact us via the direct message function of a social network, the respective platform operator also processes your message as part of its own privacy policy (see Section 6). The principles stated above apply accordingly to the processing of your inquiry by us. Detailed information on social media can be found in Section 6.
The data will be deleted as soon as it is no longer required for the respective purpose and no statutory retention obligations or other legal grounds for further storage exist.
For receiving, sending, and storing emails via our own domain, we use the email hosting services of Zoho Corporation B.V. (Beneluxlaan 4B, 3527 HT Utrecht, Netherlands; hereinafter “Zoho”). The service data that we process via Zoho Mail is generally stored in the EEA data center assigned to our account. However, under certain circumstances, particularly for support purposes, Zoho may access data from third countries such as India. For such transfers, Zoho uses the applicable data protection safeguards required under the GDPR, in particular Standard Contractual Clauses (SCCs). More information can be found here: https://www.zoho.com/de/privacy.html and https://www.zoho.com/gdpr.html
If you contact us via email or receive emails from us, the following personal data may be processed by Zoho: sender and recipient addresses, names from email signatures, subject, message content, attachments, as well as technical metadata for transmission and delivery.
The processing of personal data is based on our legitimate interest in the efficient and secure handling of communication with us (Art. 6 Para. 1 lit. f GDPR). If the contact is aimed at carrying out pre-contractual measures or fulfilling contractual obligations, Art. 6 Para. 1 lit. b GDPR is an additional legal basis.
A Data Processing Agreement pursuant to Art. 28 GDPR is in place with Zoho.
For the address stated in our legal notice, we use an address for service provided to us by IMPRESSUM-PRIVATSCHUTZ GmbH, Ludwig-Erhard-Str. 18, 20459 Hamburg, Germany (hereinafter “Impressum-Privatschutz” or “IP-Management“). Mail addressed to this address is forwarded to us by post or digitally. In doing so, personal data such as the sender's name and address, as well as any other personal data contained in the letter, may be processed. The content of the letter may also be processed for the purpose of digital forwarding.
Processing is based on our legitimate interest in using an address for service and in not having to make our private address publicly available (Art. 6 Para. 1 lit. f GDPR).
A Data Processing Agreement pursuant to Art. 28 GDPR is in place with Impressum-Privatschutz. You can find more information on privacy with Impressum-Privatschutz GmbH under https://impressumprivatschutz.de/datenschutzerklaerung/.
We operate a Discord server through which we communicate with you, e.g., in the context of playtests, bug reports, and general exchange regarding our games. Joining the server is voluntary.
If you post messages on our Discord server or contact us directly via Discord, we process the data generated in this context (Discord username, message content) as well as any other information you voluntarily provide within our server for the purpose of handling your inquiry, conducting playtests, evaluating bug reports, and facilitating general communication within the community. The legal basis for this is our legitimate interest in effective quality assurance and community management (Art. 6 Para. 1 lit. f GDPR).
For the operation of the Discord platform itself (user account, chat infrastructure, security and moderation functions), Discord Netherlands B.V., Schiphol Boulevard 195, 1118 BG Schiphol, Netherlands, is responsible as an independent controller. Information on data processing by Discord can be found in Discord's privacy policy at https://discord.com/privacy. Discord determines its own storage and deletion periods.
Where personal data is transferred by Discord to the USA or other third countries, the transfer takes place, according to Discord's information, on the basis of the applicable transfer safeguards, in particular the Standard Contractual Clauses of the European Commission and, where applicable, the EU-U.S. Data Privacy Framework.
As our Discord server is set up as a community server, we have access to the “Server Insights” function provided by Discord. Through this function, we receive aggregated statistical metrics about our server, including the number of visitors and active members, member growth and attrition, member retention, and the sources through which new members joined our server. Analytics relating to growth, interactions, and audience demographics only become available for Discord communities with 500 or more members.
To generate these metrics, Discord processes individual members' activity data in the background (e.g., channel views, message activity, join and leave times) and provides us with the technical infrastructure and the aggregated statistical evaluations derived from this data. We decide for what purposes we use these evaluations, for example to align our community activities, such as outreach, content, and event planning, with them. Where we jointly determine with Discord the purposes and means of processing personal data in connection with Server Insights, joint controllership can exist to that extent under Art. 26 GDPR. However, Discord does not currently make a separate agreement on joint controllership publicly available. Further details on processing by Discord can be found in Discord's privacy policy https://discord.com/privacy. You may exercise your data subject rights under the “General Information and Mandatory Disclosure” section in relation to the processing of personal data in connection with Server Insights against both us and Discord.
The further processing of the aggregated statistics made available to us is based on our legitimate interest in designing our Discord server according to the needs of our community (Art. 6 Para. 1 lit. f GDPR).
Our Discord server uses Discord's native “Rules Screening” function. New members must expressly confirm our server rules before they can post messages, react to messages, or send direct messages to other members. This function is technically provided by Discord Netherlands B.V. as an independent controller as part of the platform's security and moderation functions (see above). Where we, as server administrators, view the rule confirmation in order to decide on the admission of new members and to exclude spam or fake accounts, we process this data on the basis of our legitimate interest in a secure and functioning community (Art. 6 Para. 1 lit. f GDPR). Participation in our server is voluntary; however, confirmation of our server rules is mandatory.
We store information on your device about your selected page settings (e.g., the choice between a light or dark appearance and your language selection). This is done exclusively for the purpose of displaying the website in your preferred appearance when you visit again.
Preferences relating to appearance are stored exclusively in the browser's localStorage. Language preferences are stored in a cookie. Access to or storage of these preferences takes place without consent, insofar as this is strictly necessary under § 25 Para. 2 No. 2 TDDDG to provide the website settings explicitly requested by you. Where personal data is processed in this context, processing takes place on the basis of our legitimate interest in providing the website in a user-friendly manner in accordance with Art. 6 Para. 1 lit. f GDPR.
The data remains stored locally in your browser until you clear it or manually reset the settings. The cookie used to store language preferences expires automatically after one year.
Our website contains links to our profiles and presences on external platforms, e.g., social networks and our Discord server. These are exclusively simple HTML links (static hyperlinks) and not embedded social media plugins, buttons, or tracking scripts.
The mere display of these links on our website does not transmit any personal data to the platform operators. Only when you actively click on an icon or link to a platform do you leave our website and get redirected directly to the respective provider's platform. From that point onward, the respective platform operator is responsible for the processing of your data.
Please refer to the “Information on the Controller” section of this privacy policy for our studio's contact details as the operator of our profiles and pages.
Operators of the respective platforms:
Where we and the respective platform operator jointly determine the purposes and means of data processing for certain statistics or insights functions, joint controllership under Art. 26 GDPR may exist. The specific legal classification depends on the respective platform and function.
The platform operators may process personal data in connection with our profiles and provide us with statistical evaluations (e.g., regarding post reach, interactions, demographics, etc.). Even if these evaluations are only made available to us in aggregated form, the underlying processing of personal data may be carried out by the respective platform operator.
Instagram: For the Page Insights provided by Meta, joint controllership with Meta exists in relation to the associated processing.
TikTok: Joint controllership exists for certain analytics and insights functions provided by TikTok.
Reddit: We do not use any analytics, insights, or advertising functions offered by Reddit in connection with our presence. Accordingly, no joint controllership within the meaning of Art. 26 GDPR arises from our use of Reddit.
Further links to existing agreements can be found here:
For Instagram and TikTok, the respective platform operators provide a framework of agreements governing joint controllership. However, YouTube (Google) and X currently do not make separate agreements on joint controllership publicly available. Where we are involved, through the operation and configuration of our profiles, in determining the purposes and means of the respective analytics or insights processing, joint controllership can exist to that extent within the meaning of Art. 26 GDPR.
We expressly point out that we do not have full and complete control over the data processing carried out by YouTube (Google), X and by extension all other platforms. In particular, the respective platform operators determine essential aspects of the technical design and processing operations. We use the platforms and the aggregated statistics made available to us on the basis of our legitimate interest in current public relations, community management, and targeted communication (Art. 6 Para. 1 lit. f GDPR). Where joint controllership exists, you may exercise your data subject rights against both us and the respective platform operator. Since only the respective platform operator has direct access to the user data processed there, it may be advisable to contact them directly with inquiries concerning data stored or processed there. You may, of course, also exercise your rights against us; we will handle such requests to the extent possible or forward them to the responsible controller.
We process personal data when you contact us directly through our profiles. This includes user data, messages, comments, or feedback about our games (e.g., bug reports).
Purposes and Legal Bases:
When visiting our profiles, the respective platform operators may process personal data for their own purposes. The type and scope of this processing are governed by the respective privacy policies of the platform operators.
Where the respective platform operators transfer personal data to third countries, this is carried out, according to the respective provider, on the basis of the EU-U.S. Data Privacy Framework (DPF) or the European Commission's Standard Contractual Clauses (SCCs), where applicable.
Detailed information on data processing and privacy settings can be found in the privacy policies of the providers:
You may exercise your data subject rights under the “General Information and Mandatory Disclosure” section against both us and the respective platform operator. Where your inquiry relates exclusively to processing carried out by the platform operator, it may be advisable to contact them directly.
